TutorFee Terms & Conditions

These Terms & Conditions ("Terms") govern your access to and use of the TutorFee website, mobile application, web application, software services and related services (collectively, the "Service").

TutorFee is operated by [LEGAL BUSINESS NAME], of [BUSINESS ADDRESS], Sri Lanka ("TutorFee", "we", "us" or "our").

By creating an account, accessing, subscribing to, or using TutorFee, you agree to be bound by these Terms. If you do not agree with these Terms, you must not use the Service.

1.About TutorFee

TutorFee is a software platform designed primarily to help tuition teachers and educational service providers manage their tuition-related activities. Depending on the features available to your account and subscription plan, TutorFee may provide functionality including:

  • Teacher account management
  • Tuition class management
  • Student management
  • Student enrollment management
  • Attendance management
  • QR-based attendance functionality
  • Tuition fee and payment record management
  • Dashboard and administrative tools
  • SMS-related functionality and credits
  • Subscription and plan management
  • Offline functionality within supported mobile application features
  • Synchronisation of supported data between the mobile application and cloud services

Features may vary depending on the account type, subscription plan, application version, platform, region and availability. TutorFee is a software tool. TutorFee does not itself provide tuition classes, teaching services, educational certification, financial services or payment collection services on behalf of teachers.

2.Eligibility

You must provide accurate information when creating and maintaining your account. You are responsible for ensuring that you are legally permitted to use the Service.

If you use TutorFee on behalf of a school, tuition class, academy, business or other organisation, you confirm that you have the authority to accept these Terms on behalf of that organisation.

TutorFee is primarily intended for use by teachers and educational service providers. Where student information, including information relating to children or minors, is entered into TutorFee, the teacher or organisation using TutorFee is responsible for ensuring that it has an appropriate lawful basis, authority, consent or other legal justification for collecting and providing that information to TutorFee for processing.

3.Account Registration

You may be required to create an account to use certain features. You agree to:

  • Provide accurate and current information;
  • Keep your account information up to date;
  • Keep your login credentials confidential;
  • Not share your account with unauthorised persons;
  • Notify us if you suspect unauthorised access;
  • Use the Service only for lawful purposes.

You are responsible for activity performed through your account unless the activity resulted from a security failure attributable to TutorFee. TutorFee may require account verification or administrative approval before providing access to certain features.

4.Teacher Account Approval

TutorFee may operate an account approval process for teacher accounts. Registration does not automatically guarantee approval. TutorFee may review registration information and may approve, reject, suspend or block an account where reasonably necessary to protect the Service, users or comply with applicable law. We may request additional information where necessary to verify an account.

5.Your Responsibility for Student Information

TutorFee allows teachers to store information about students. The teacher or organisation using TutorFee remains responsible for the information entered into the Service and for ensuring that its collection and use comply with applicable laws and its responsibilities toward students and parents/guardians. This may include information such as:

  • Student names;
  • Telephone numbers;
  • Parent/guardian contact information;
  • Class information;
  • Enrollment information;
  • Attendance records;
  • Tuition fee records;
  • Payment records;
  • Other information entered by the teacher.

You must not enter information into TutorFee unless you are authorised or otherwise legally permitted to do so. You must take particular care when entering information relating to children or minors. TutorFee does not determine whether a teacher has obtained any consent, authorisation or other lawful basis required for the information they enter.

6.Acceptable Use

You must not use TutorFee to:

  • Break or violate any applicable law;
  • Commit fraud or other unlawful activity;
  • Upload malicious software;
  • Attempt to gain unauthorised access to TutorFee systems;
  • Attempt to access another user's data;
  • Interfere with the operation or security of the Service;
  • Reverse engineer or attempt to obtain source code except where permitted by applicable law;
  • Circumvent subscription or feature restrictions;
  • Abuse SMS functionality;
  • Send unlawful, fraudulent, threatening, abusive or unsolicited messages;
  • Use TutorFee to distribute content that violates another person's rights;
  • Impersonate another person or organisation;
  • Use the Service to conduct activities that create unreasonable security, legal or operational risks.

We may restrict or terminate access where we reasonably believe that the Service is being misused.

7.Student and Parent Communications

Where TutorFee provides SMS or other communication functionality, the teacher is responsible for the content, recipient information and lawful basis for sending communications. You must ensure that messages:

  • Are sent to the intended recipient;
  • Are accurate;
  • Are relevant to your legitimate educational/business activities;
  • Do not contain unlawful or misleading content;
  • Comply with applicable Sri Lankan requirements concerning electronic communications and personal data.

TutorFee may restrict messaging functionality where necessary to prevent abuse, fraud, excessive use or unlawful communications.

8.SMS Credits

Where SMS credits are available, credits may be consumed when messages are processed or sent through the supported SMS service. SMS delivery may depend on telecommunications networks and third-party SMS providers. TutorFee does not guarantee that every SMS will be successfully delivered. Delivery may be affected by:

  • Incorrect recipient numbers;
  • Network failures;
  • Telecommunications provider restrictions;
  • Recipient device conditions;
  • Provider outages;
  • Regulatory restrictions;
  • Message content;
  • Other circumstances outside TutorFee's reasonable control.

SMS credits may be subject to the rules described in the applicable pricing or credit purchase terms.

9.Subscription Plans

Certain TutorFee features may require a paid subscription. Available plans, prices, included features, usage limits and entitlements are displayed on the TutorFee website or within the applicable application. Subscription plans may include limitations such as:

  • Maximum number of students;
  • Maximum number of classes;
  • Included SMS credits;
  • Feature availability;
  • Storage or usage limits;
  • Other plan-specific restrictions.

TutorFee may introduce, modify or discontinue plans or features, subject to applicable law and any rights already acquired by a customer for a paid subscription period.

10.Free Trials

TutorFee may offer free or promotional trial periods. The length and conditions of a trial will be communicated when the trial is provided. Unless otherwise stated, a trial does not guarantee continued access to paid features after the trial period ends. At the end of a trial, access may be restricted, suspended or converted to a paid subscription where the user has expressly selected or authorised such subscription.

11.Payments

Payments for TutorFee subscriptions and other paid services may be processed through third-party payment providers. TutorFee may use PayHere or another supported payment provider for payment processing. TutorFee does not store complete payment card details when those details are processed directly by the payment provider. Payment information may be processed according to the applicable third-party provider's terms and privacy policy. The price payable for a subscription or purchase will be displayed before payment is completed.

12.Subscription Renewal

Where recurring subscriptions are offered, the applicable renewal terms will be displayed before or during subscription purchase. You may cancel future renewals using the available cancellation mechanism or by contacting TutorFee support where applicable. Cancellation of a subscription normally prevents future renewal but does not necessarily provide an automatic refund for a period that has already been paid for. Any refund rights are subject to the applicable Refund & Cancellation Policy and applicable Sri Lankan law.

13.Refunds and Cancellations

Refunds are not automatically guaranteed for every purchase. Refund eligibility may depend on:

  • The product or service purchased;
  • Whether the subscription period has started;
  • Whether credits have been used;
  • Whether the payment was duplicated or made in error;
  • Applicable consumer protection law;
  • The specific refund terms displayed at the time of purchase.

Any applicable refund or cancellation rights will be described in TutorFee's Refund & Cancellation Policy. Nothing in these Terms is intended to remove or restrict any mandatory consumer rights available under Sri Lankan law.

14.SMS Credit Purchases

Where SMS credit packages are sold separately, the number of credits and applicable price will be displayed before purchase. Used SMS credits may not be refundable unless required by applicable law or expressly stated otherwise. Credits may expire or become unavailable if the associated account is terminated where such conditions have been clearly disclosed.

15.Offline Functionality

The TutorFee mobile application may support offline functionality. Offline availability means that certain information can be stored locally on the supported device and synchronised with cloud services when connectivity becomes available. Not every feature is necessarily available offline. The user is responsible for ensuring that:

  • The device is reasonably secure;
  • The application is kept updated;
  • Unauthorised persons cannot access the device;
  • The device has sufficient storage;
  • The application is allowed to synchronise when connectivity is available.

TutorFee cannot guarantee uninterrupted synchronisation in all circumstances.

16.Data Synchronisation

TutorFee may synchronise supported mobile application data with its cloud infrastructure. Synchronisation can be affected by:

  • Internet connectivity;
  • Device storage;
  • Application errors;
  • Service outages;
  • Server availability;
  • Third-party infrastructure;
  • Incorrect or conflicting data.

Users should not rely on TutorFee as their sole permanent backup for critical business records.

17.Data Ownership

You retain your rights in the information and content that you lawfully provide to TutorFee. You grant TutorFee the limited rights necessary to host, process, store, synchronise, transmit and otherwise provide the Service. TutorFee does not acquire ownership of your student records merely because you store them using the Service.

18.Intellectual Property

The TutorFee name, logo, software, source code, user interface, designs, documentation, graphics, trademarks and other original materials provided by TutorFee are owned by or licensed to TutorFee and are protected by applicable intellectual property laws. Except where expressly permitted, you may not:

  • Copy TutorFee software;
  • Reproduce the user interface for commercial purposes;
  • Resell the Service;
  • Modify or distribute TutorFee software;
  • Remove proprietary notices;
  • Use TutorFee branding without permission.

19.Third-Party Services

TutorFee relies on certain third-party services and infrastructure. These may include services such as:

  • Firebase / Google Cloud infrastructure;
  • PayHere for payment processing;
  • Third-party SMS providers;
  • Hosting and infrastructure providers;
  • Analytics, security or technical services where implemented.

Third-party services may have their own terms, privacy policies, service limitations and outages. TutorFee is not responsible for failures caused solely by a third-party provider outside TutorFee's reasonable control.

20.Service Availability

We aim to keep TutorFee available and reliable, but we do not guarantee that the Service will always be:

  • Available;
  • Error-free;
  • Uninterrupted;
  • Completely secure;
  • Compatible with every device;
  • Free from bugs.

Maintenance, upgrades, security events, network failures and third-party service failures may temporarily affect availability.

21.Security

TutorFee implements reasonable technical and organisational measures intended to protect information and systems. However, no internet-based system can be guaranteed to be completely secure. You are responsible for protecting your own account credentials and device.

22.Suspension and Termination

TutorFee may suspend or terminate an account where reasonably necessary because of:

  • Serious violation of these Terms;
  • Fraud;
  • Abuse;
  • Security threats;
  • Unlawful activity;
  • Non-payment;
  • Abuse of SMS functionality;
  • Attempts to compromise the Service;
  • Other circumstances where continued access creates material risk.

Where reasonably possible, we may provide notice before suspension or termination. Nothing in this section limits any rights available under applicable law.

23.Effect of Account Termination

After account termination, access to the account may be disabled. Subject to applicable law and our retention obligations, personal data and account data may be deleted after an appropriate retention period. Certain information may need to be retained where required for:

  • Legal compliance;
  • Fraud prevention;
  • Financial/accounting records;
  • Dispute resolution;
  • Security;
  • Enforcement of legal rights.

24.Backups

TutorFee may maintain technical backups for operational and disaster-recovery purposes. Backups are not intended to replace the user's own responsibility for maintaining copies of important business records where appropriate.

25.No Professional Advice

TutorFee is software for administrative management. TutorFee does not provide:

  • Legal advice;
  • Accounting advice;
  • Tax advice;
  • Educational certification;
  • Financial advice.

You are responsible for obtaining professional advice where necessary.

26.Accuracy of Records

TutorFee provides tools for recording and organising information. TutorFee does not guarantee that information entered by users is accurate. Teachers are responsible for verifying:

  • Student information;
  • Attendance information;
  • Fee amounts;
  • Payment records;
  • Contact information;
  • SMS recipient information.

27.Limitation of Liability

To the maximum extent permitted by applicable Sri Lankan law, TutorFee will not be responsible for indirect, incidental, special or consequential losses arising from the use or inability to use the Service. This may include loss arising from:

  • Business interruption;
  • Loss of expected revenue;
  • Loss of data caused by circumstances outside TutorFee's reasonable control;
  • Third-party service failures;
  • Incorrect information entered by a user;
  • Telecommunications failures.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

28.Force Majeure

TutorFee will not be responsible for delays or failures caused by circumstances beyond its reasonable control, including:

  • Natural disasters;
  • Telecommunications failures;
  • Internet outages;
  • Government actions;
  • Cybersecurity incidents;
  • Power failures;
  • Third-party infrastructure failures;
  • Civil disturbances;
  • Other events beyond reasonable control.

29.Changes to the Service

TutorFee may improve, modify or update the Service from time to time. Changes may include:

  • New features;
  • Feature improvements;
  • Security updates;
  • Bug fixes;
  • Changes to user interfaces;
  • Changes to supported devices;
  • Changes to third-party integrations.

Where a material change affects paid services, we will provide appropriate notice where required by law.

30.Changes to These Terms

We may update these Terms from time to time. The updated version will be published on the TutorFee website with an updated "Last Updated" date. Where legally required, we may provide additional notice of material changes. Continued use of the Service after the effective date of updated Terms may constitute acceptance of the updated Terms to the extent permitted by law.

31.Privacy

Your use of TutorFee is also governed by the TutorFee Privacy Policy. The Privacy Policy explains how TutorFee collects, uses, stores, shares and protects personal data.

32.Complaints and Support

We will make reasonable efforts to review and respond to complaints. Nothing in these Terms prevents a consumer from exercising any rights or remedies available under applicable Sri Lankan law.

33.Governing Law

These Terms are governed by the laws of the Democratic Socialist Republic of Sri Lanka, subject to any mandatory rights or protections that cannot lawfully be excluded. Any dispute should first be raised with TutorFee so that the parties have a reasonable opportunity to resolve it. Where a dispute cannot be resolved directly, the parties may use any dispute-resolution mechanism or legal remedy available under applicable Sri Lankan law.

34.Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

35.Entire Agreement

These Terms, together with the Privacy Policy, Refund & Cancellation Policy and any other terms expressly incorporated into them, form the agreement governing your use of TutorFee.
